Creator Terms of Service

These Creator Terms of Service concern all members who register as Creators and post content through all services (hereby referred to as 'services') featured on Beyond Publishing Perspectives' (hereby referred to as 'company') website MANGA REBORN (hereby referred to as 'site'). All site members who register as Creators and post content are required to follow these policies. Please read the entire TOS.

Article 1 (Definition)

  1. Creators are not normal members, but members who register as authors, translators, letterers, or fan artists.

Article 2 (Copyright Protection)

  1. Creators ensure that all content posted by Creators on the site does not infringe on any third party's copyright, likeness or other rights.
  2. Creators ensure that they bear all copyrights and rights as outlined in Article 3 to all contents they upload to the company.
  3. Creators ensure that if any copyright problems or damage to the company or any third parties arise, the Creator will bear full responsibility.
  4. We ensure that we will fulfill all duties pertaining to Creator TOS and Creator rights.

Article 3 (Company Rights)

  1. (1) If a Creator submits a work onto the site that has already been released somewhere else (hereby referred to as a previously-released work) in any country, including Japan, the creator consents the non-exclusive right for that work or a part of that work to be distributed through all of the following methods for 3 years from the submitted date. This includes consent to make the necessary changes for a work to be distributed electronically, as well as the use of voice technology for automatic reading functionality.
      1. The distribution and copying of a packaged work on an electronic medium (including all future technology that may be developed) such as DVD-ROM or memory cards.
      2. The mass distribution of the work through the internet (including being able to download the work's data and online viewing through the home page).
      3. The translation of a work into multiple languages.
      4. The creation of a completely new work through manipulation while retaining the essential nature of the original work.
      5. The inclusion of the work into a searchable, viewable database.
  2. (1) If a Creator submits a work onto the site that has not already been released somewhere else (hereby referred to as an unreleased work) in any country, including Japan, the creator consents the exclusive right for that work or a part of that work to be distributed through all of the following methods, excluding special terms that the company agrees to in writing. This includes consent to make the necessary changes for a work to be distributed electronically, as well as the use of voice technology for automatic reading functionality.
      1. The distribution and copying of a packaged work on an electronic medium (including all future technology that may be developed) such as DVD-ROM or memory cards.
      2. The mass distribution of the work through the internet (including being able to download the work's data and online viewing through the home page).
      3. The translation of a work into multiple languages.
      4. The creation of a completely new work through manipulation while retaining the essential nature of the original work.
      5. The inclusion of the work into a searchable, viewable database.
    (2)Creators understand that the company can give consent to third parties regarding the above uses.
  3. Creators understand that the company can add new captions, keywords, additions or changes to works up to a certain degree in order for them to be electronically distributed.

Article 4 (Copyright Fee Payments)

  1. The company will pay a separate copyright fee to Creators in exchange for the usage outlined in Article 3. However, fees will not be paid for translated works and remakes.
  2. Regardless of the terms outlined in Article 3, royalties will not be paid from usage of works in advertising, promotion, sales promotions, or other similar business uses.

Article 5 (Company Obligations)

  1. The rights of digital data created through Creators' work and capital, (including intermediate products still in production, hereby referred to as 'usage data') as stipulated in Article 3, do not belong to the company.
  2. When the company deems it necessary to change the title or contents of a work, the company must receive consent from the copyright holder in order to do so.
  3. The company will be careful to preserve all rights of Creators and provide ample service to members regarding copyrights.

Chapter 6 (Releases)

  1. A creator's posted work will be released to the public as long as none of the following conditions apply:
      1. The contents of the work damage the trust or reputation or contribute to unjust discrimination of a third party, or slanders or discriminates unjustly against the company or a third party.
      2. The work is connected to a particular company's business.
      3. The work is connected to a particular candidate or politician's campaign.
      4. The purpose of the work is to propagate a certain religion.
      5. The work is connected to the abuse of controlled substances, fraud, child prostitution, or illegal transactions with cell phones and savings accounts.
      6. The work was made to entice or help juveniles run away from home.
  2. The company will notify a Creator with a reason within 10 days from when a released work becomes un-viewable.
  3. A Creator can re-submit a work that has become un-viewable after editing it, whereupon the company will decide whether it still fulfills any of the conditions in Section 1.

Article 7 (Removal)

  1. Creators can remove any viewable work. The company will delete all contents in question one month after the request is received.
  2. Regardless of the details in Section 1, Creators cannot remove a translated work created from the Creator's work by a third party unless the company authorizes it in writing.

Article 8 (Viewing Suspension)

  1. Creators can remove any viewable work. The company will delete all contents in question one month after the request is received.
  2. Regardless of the details in Section 1, Creators cannot remove a translated work created from the Creator's work by a third party unless the company authorizes it in writing.

Article 9 (Fees)

  1. If a Creator takes a remake or translation of a work that was made on this site and sells it somewhere off the site, the Creator will pay a separate fee to the company.
  2. The company can sell a remake or translation of a work that was made on this site elsewhere.

Article 10 (Site Sales)

  1. Members can sell unreleased works through the service on the site.
  2. Works can also be sold through the site's partner sites.

Article 11 (Outer Sales)

  1. If a Creator wishes to sell an unreleased work somewhere other than the site, the Creator must receive consent from the company.
  2. When the Creator sells an unreleased work somewhere else than the site, the price must be the same or greater than the price on the site.

Article 12 (Prohibition of Transfer of Claims and Obligations)

  1. Creators are prohibited from transferring claims and obligations outlined in the Creator TOS to a third party without written authorization from the company.

Article 13 (Exemptions)

  1. The company will not involve itself in disputes between a third-party and a Creator if a work infringes on a third party's copyrights.
  2. If a dispute between a third-party and a Creator arises from a work infringing on a third party's copyrights, the company will stop payments of the copyright fees as stipulated in Article 4.

Article 14 (Response to Copyright Infringements)

  1. If a copyright infringement is made by a third party, or if the rights of the Creator or company as stipulated in the TOS are infringed upon, the company will assist the Creator.

Article 15 (Relationships to other TOS)

  1. The company deems this TOS effective on members in conjunction with the site's other TOS.
  2. If the TOS and Creator TOS stipulations contradict one another, the Creator TOS is to be honored.

Article 16 (Revisions)

  1. The company may revise the Creator TOS at any time. In this event, the revised Creator TOS will become effective as soon as they are posted on the site. If members use the service after the Creator TOS have been revised, it is assumed that they agree to the Creator TOS. 。

Article 17 (Applicable Laws)

  1. All actions done under the Creator TOS shall be governed by, construed, and interpreted under the laws of Japan.
  2. The original copy of the Creator TOS was written in Japanese, and all other language versions are merely translations and therefore bear no legal force or authority.
  3. If a lawsuit becomes necessary in regards to an action done under the Creator TOS, The Tokyo District Court will be the exclusive jurisdictional court of the first hearing.
